OBLIGATIONS OF THE PARTIES
OBLIGATIONS OF TG TRAVEL
A minimum of 40 participants must be secured for the package tour to take place. In case of fewer participants or unforeseen circumstances, TG TRAVEL reserves the right to cancel the tour and offer an equivalent alternative tour. Tour cancellation will be notified to the tour participant 21 days before the start of the tour.
TG TRAVEL undertakes to exercise all necessary care to ensure that the services specified in the tour program are provided on time and with the expected quality. However, TG TRAVEL cannot be held liable for non-performance or improper performance of the contract due to extraordinary or force majeure events such as malfunctions, accidents, losses, and similar situations occurring outside TG TRAVEL's control in transportation vehicles or accommodation facilities; political events, strikes, changes in international relations, terrorist acts, social movements, war risks, natural disasters, adverse weather conditions, fog, and unpredictable technical failures; as well as in cases arising from the consumer's own fault. In such situations, the consumer has no right to claim compensation.
The tour participant accepts that they may receive SMS, e-mail, and similar notifications from all operators, as well as notifications regarding TG TRAVEL's special advertising and services, based on the information regarding the package tour reservation made through TG TRAVEL within the scope of this contract. Photos and videos taken during the tour may be used in TG TRAVEL promotions. Tour participants are deemed to have accepted this.
OBLIGATIONS OF TOUR PARTICIPANTS
When the reservation process begins, it is mandatory to inform the tour participants about the tour flow within the tour program and the tour contract. The tour program and the tour contract are an integral part of each other. It is deemed that the tour participants have read and accepted all clauses within the tour program and tour contract at the time of reservation and completed their transactions accordingly. TG TRAVEL cannot be held liable for any complaints arising from this information.
Other participants joining the package tour along with the consumer who signed this contract but did not sign it themselves, and whose participation fee was paid by the signing consumer, are also deemed to have read, accepted, and committed to the provisions of this contract. Despite this, if they initiate a lawsuit or any legal process against TG TRAVEL citing that their signatures do not appear directly in the contract, and consequently TG TRAVEL is forced to pay compensation or suffers direct or indirect damage, TG TRAVEL reserves the right to take all legal actions against the relevant consumer for recourse regarding the damages incurred or payments made.
In case this Package Tour Contract is signed between the authorized Agency and the consumer, the relevant authorized Agency shall be jointly and severally liable for all obligations and responsibilities stipulated in this contract.
For minors traveling without parents accompanied by third parties, a notarized consent form is required. Any travel problems arising from the inability to provide this document are the sole responsibility of the tour participant.
Tour participants are obligated to comply with the social norms, laws, or regulations, health and safety rules (vaccinations, local regulations) of the country visited. The tour participant is personally responsible for all legal and material penalties resulting from non-compliance with these rules or excessive behavior.
The consumer is obligated to report any discrepancies or deficiencies encountered during the performance of the service in writing to the competent authorities. If the consumer terminates the tour on the grounds that the service is defective, they must notify TG TRAVEL authorities and the hotel where they stayed in writing with reasons. Otherwise, the consumer is deemed to have left the tour of their own free will and is considered to have fully utilized the service, and no refund will be made.
If the consumer continues to benefit from the service despite complaining, their right to request substitute services, refunds, or compensation based on those complaints ceases.
The tour participant declares that there is no health problem preventing them from traveling and accepts any liabilities that may arise otherwise.
GENERAL PROVISIONS REGARDING THE PACKAGE TOUR
Since TG TRAVEL is bound by the "1955 Hague Protocol", it acts as an intermediary between the airline and the tour participants. Due to current airline conditions, flight times, dates, airports or cities of departure/arrival may change. This situation will be reflected in the tour program, revised, and information will be provided. Tour participants must contact the agency 48 hours before the tour day to obtain written confirmation of flight details. It is accepted that tour participants are aware of this information. TG TRAVEL is not liable for any issues arising from changes in flight details dependent on the airline.
TG TRAVEL is not liable for changes affecting domestic connecting flights or other modes of transport due to changes in flight details, if applicable.
It is recommended that tour participants be present at the specified airport on the flight day at least 4 hours before the flight time to complete check-in and baggage procedures. TG TRAVEL is not liable for instantaneous changes made by the airline before the flight and any resulting delays (such as missing the flight). It is the responsibility of the tour participants to follow real-time information via airport digital screens, announcements, or by consulting the staff at the counter.
All transactions, including hotel reservations and flight ticketing, are carried out according to the name entered in the reservation. To ensure all transactions are error-free and complete, records must be made according to the information on the passport during reservation. Penalty amounts arising from change requests are the responsibility of the tour participants. In this case, the tour participant cannot claim any rights from TG TRAVEL.
Flight ticket transactions are blocked for group flights according to the tour and are processed based on different ticketing processes and rules compared to individual tickets. Ticket class changes, additional baggage allowance, seat selection, or check-in are transactions that can be done directly by contacting the airline. Airlines may charge fees for these additional services. This fee difference depends on airline procedures and has no relation to the tour fee paid to TG TRAVEL.
Group tickets are issued as two round-trip tickets. If the outbound ticket is not used, the return ticket may become invalid. This rule depends on airline procedures, and all operations related to unused or burnt tickets will be done according to the airline's response. All delays resulting from this situation are the responsibility of the tour participant, and TG TRAVEL has no obligation to compensate.
The rules of sea, air, and road transportation vehicles to be used during the tour apply. The tour participant should organize their luggage according to these rules and should not place inappropriate materials (cutting tools, sharp objects, flammable/explosive substances, money, valuable documents, etc.). It is accepted by the parties that TG TRAVEL is not liable for any damage, such as luggage not being accepted, damaged, belongings getting wet, lost, etc., primarily due to placing inappropriate materials in these transportation vehicles or for any other reason.
Protecting valuables, jewelry, suitcases, bags, wallets, money, or passports and taking security measures is the personal responsibility of the tour participants. TG TRAVEL has no liability or obligation in this regard. We may recommend that tour participants purchase comprehensive additional travel insurance, rent a safe deposit box (safe box) at the hotel, keep a photocopy of one page of their passport with them, and not bring valuable documents and jewelry on the tour.
During the continuation of the package tour and during "free time periods" without the guide's accompaniment, the tour participant must immediately apply to the security forces of the country they are in regarding crimes such as theft, robbery, or crimes causing a decrease in property. It is accepted by the parties that TG TRAVEL will not be held liable for any material or moral loss resulting from this.
The names of hotels offered in the tour program do not mean confirmed hotel reservations; they are given to serve as examples in terms of star category and distance. Hotel names may be changed while keeping the star category the same. Details of the hotel where tour participants will stay will be notified 48 hours before the tour day. TG TRAVEL reserves all its rights regarding this.
According to international standards, hotel check-in time is generally 14:00 or 15:00, and check-out time is 12:00. An extra fee is required for early check-in or late check-out requests, and allocation is possible depending on availability. The tour participant is obligated to make this payment themselves; TG TRAVEL will not make any payment for any expenses not included in the tour program.
The general structure of hotel rooms is quite small and the room type is standard. Extra beds may be arranged as smaller portable foldable structures than normal bed sizes or as a sofa (couch) if available in the room. Congestion in the room cannot be addressed. Double beds (one large double bed for two people) are provided by the hotel depending on availability.
Various services such as minibar, safe deposit box, laundry, telephone, some soft or alcoholic beverages, spa, room upgrades, and private tours offered at the hotel are provided for a fee. The tour participant can learn the details of paid and unpaid services from the hotel. Any extra expense incurred is personal, and TG TRAVEL will not make any payment for any extra expense other than the included services specified in the tour program.
Breakfasts served at foreign hotels are quite simple due to cultural differences. TG TRAVEL has no right to intervene in the menu content determined by the hotel management or the venue selected for group breakfasts.
All expenses related to food and drink during the tour (breakfast, lunch, dinner, snacks, etc.) belong to the tour participant personally.
The route in the tour program is an example, and TG TRAVEL reserves the right to make changes to the route while keeping the content the same for any reason it deems necessary.
Rest stops may be made at rest facilities along the tour route according to the captain's or guide's discretion.
Panoramic city tours are conducted from inside the vehicle to give a preview of the streets, buildings, and some prominent places of the city visited and are included in the tour. For tour participants who do not wish to just have a beach, sand, sun holiday, there are extra tour options. Extra tours can be purchased individually or as discounted group packages. Tour participants who did not purchase an extra tour package during reservation can also purchase them with cash payment during the briefing meeting held by the guide at the hotel on the first day of the tour. Extra tour prices do not include museum and historical site entrance fees.
To implement extra tours, a certain number of participants, such as 15, must be secured. In case of fewer participants, extra tours may not take place or may take place depending on the guide's discretion, and a price difference may occur.
TG TRAVEL reserves the right to propose alternative extra tours for extra tours that do not take place for any reason included in the tour program.
Additionally, extra tours may not take place due to adverse weather conditions, legal restrictions, or any other reason outside TG TRAVELS' control area. Refunds for extra tours cancelled by the agency due to force majeure may be provided to tour participants depending on the payment made by the supplier.
In optional extra tour cancellations; tour participants may submit an extra tour cancellation request by informing the agency and guide at least 48 hours before the extra tour day. A refund for the extra tour may be made depending on the payment made by the supplier. Due to the processing and density in the region, reservations are made for specific quota numbers, and payments to suppliers are made urgently; therefore, refunds cannot be provided for optional cancellations exceeding the deadline.
Guides in the region will accompany the group throughout the tour program. This accompaniment starts with pickup at the airport and continues with panoramic tours and extra tours. Except for tours, guides have no additional duties or responsibilities. Depending on the guide's approval and necessity, the order in the tour program may vary while maintaining fidelity to the itinerary content specified by the guide.
Tour participants must adhere to the times specified by the guide for gathering. Delays caused by being at a different location or time than specified are outside the guide's responsibility and are considered the personal choice of the tour participants.
Transfer and waiting times may extend due to seasonality, inclusion of different organizations, precautionary closures, road construction, or other uncontrollable situations. In such cases, TG TRAVEL has no liability.
Tour participants who behave in a way that disrupts the order of the tour program and the peace of the group may be removed from the group if the guide deems it appropriate and necessary. In this case, the tour participant accepts that they cannot make any claim or request for refund regarding the remaining services.
The tour participant acknowledges and declares that they are personally responsible for any damage and loss that may occur and that suppliers may demand as a result of the tour participant's requests for changes to hotels, transportation, etc.
During the tour, internet access must be available on your mobile devices so that tour participants can communicate more easily with the tour guide. They can enable their devices for international use, buy disposable SIM cards, or connect to free wifi points. The tour participant is deemed to have accepted the risks arising from this choice in making their selection.
Guidance services are generally provided in the Turkish language. In some cases, when English-speaking guides with badges are present in the region, services are provided with Turkish translation. In other cases, an additional fee may be applied for requests for services in different languages.
PROVISIONS REGARDING PASSPORT, VISA PROCEDURES, TRAVEL HEALTH INSURANCE, AND CONSULTANCY SERVICES
Tour participants holding T.C. Special (Green) passports must have a passport issuance period not exceeding 10 years. Passports that have completed this period and have not been renewed may experience problems in entry-exit procedures to the country. Liability in this regard is personal, and TG TRAVEL has no liability.
If damage is detected on the passport during passport controls, officials may not grant travel permission. We recommend renewing damaged passports. Liability in this regard is personal, and TG TRAVEL has no liability.
The passport validity date must be "at least six months beyond the end date of the trip". Passports with shorter validity periods are subject to the discretion of customs officials providing travel permission and may not grant entry-exit permission to the country. All liability in this regard is personal, and TG TRAVEL has no liability.
If the country visited requires a visa prerequisite for entry; we recommend ensuring that the relevant visa procedures are completed and the stamp, impression, or document is inside the passport, and checking the consistency of the information on the visa with your personal information (Name, Surname, Date of Birth, dates covered by the visa, duration, etc.). All liability in this regard is personal, and TG TRAVEL has no right to claim compensation.
TG TRAVEL provides only consultancy services in visa procedures. Responsibility lies with the individual for all matters such as submitting documents completely by the date specified by the agency, meeting the requested criteria, arriving on time for appointments, etc. Visa approval or rejection is a matter of consular discretion, and TG TRAVEL is in an intermediary position between the tour participant and application centers. Liability in this regard is personal, and TG TRAVEL has no right to claim compensation.
To begin visa procedures; documents must be submitted at least 30 days in advance for door and electronic visas, and at least 90 days in advance for Schengen or other visas. TG TRAVEL is not liable for delays and various disruptions at consulates.
If the tour participant wishes to carry out visa procedures individually, the necessary documents will be sent to them 1 working day after their request. If the package tour route includes more than one country, a visa application must be made for the country of first entry or the country where the longest stay will be made. Otherwise, TG TRAVEL is not liable if customs officials do not grant permission to enter the country.
In case of tour cancellation at the tour participant's own request or if they receive a visa rejection, if TG TRAVEL has started processing on the obtained visas, payments will have been made to the relevant parties, so no refund can be made. However, in case of cancellations made by TG TRAVEL for any reason, it may undertake the refund of the "fee collected only for consultancy" (provided the visa obtained by us is not used), but refunds cannot be provided for payments made to consulates and application centers.
TG TRAVEL includes mandatory professional travel insurance in the package tour for 10 USD. In case the tour participant requests tour cancellation for any unilateral reason, if there is less than 15 days until the start of the tour, the mandatory travel insurance fee cannot be refunded. Apart from the mandatory travel insurance, tour participants may choose to insure against costs of return to the starting point in case of accident and illness, and any damage arising from any kind of accident and treatment costs. The date of this special travel health insurance to be made by the tour participant should be one day before the start of the tour and one day after the end of the tour.
The coverage scope regarding insufficient or defective performance, damage, loss, and losses of consumers who purchased travel health visa insurance or have travel insurance included in the travel package is determined by the policy provisions issued by the insurance company providing the service. TG TRAVEL has no liability regarding the scope, content, and manner of application of these guarantees.
The document related to travel insurance must be on your mobile device or a printed copy must be with the tour participant throughout the trip. Fines resulting from the inability to show travel insurance during official checks are the responsibility of the tour participants, and TG TRAVEL has no liability.
We recommend that tour participants comply with the limits determined for cash money entry in the customs legislation of the country they are visiting, exchange currency as needed to minimize exchange rate differences, and prefer new banknotes. All decisions taken and liabilities arising in these matters belong entirely to the tour participant.
All payments not included in the tour price, such as hotel tax, tourism tax, or foreign exit stamp duty, are the responsibility of the tour participant. The tour participant is obligated to make these payments directly to the relevant institutions.
PROVISIONS REGARDING PACKAGE TOUR FEE, PAYMENT, CANCELLATION, AND ASSIGNMENT OF RIGHTS
The tour participant must make all payments for the tour in the currency specified in the tour program. If they choose to pay in a different currency, the bank exchange rate specified by the agency on the transaction day will be taken as basis; the exchange rate difference belongs to the tour participant.
If a credit card is chosen as the payment method, interest, maturity difference, and exchange rate difference will be calculated separately and added to the package tour fee. The tour participant is obligated to pay these differences arising from this payment method.
In case the tour participant's registration for the package tour specified in this contract is made via the www.tg-travels.com website, the tour participant will pay 100% of the package tour fee. In other purchasing methods, they must pay 50% of the package tour fee at the time of registration and the remaining amount at least 30 days before the tour day. In case the payment is not made within the specified period, the reservation will be cancelled without further notice, and the received 50% payment will remain with TG TRAVEL.
Tour participants wishing to purchase discounted package tours scheduled for specific dates must pay the full amount (100%) of the payment at the time of reservation registration.
If the tour participant terminates the contract and cancels the package tour up to 31 days before the start of the package tour, the full amount of the package tour fee they made (after deducting expenses arising from mandatory taxes, duties, and similar legal obligations, mandatory travel health insurance, and payments made to third parties related to the package tour that cannot be recovered) will be refunded. This clause does not apply to early reservations or discounted package tours, and no fee refund or compensation will be given.
In case of contract termination and package tour cancellation between 31-21 days before the start of the package tour, 50% of the package tour fee will be refunded; if 20 days or fewer days remain, no fee refund will be made under any circumstance. In case of contract termination and package tour cancellation; visa, travel insurance, and mandatory insurance fees will not be refunded under any circumstances.
The tour participant may assign their tour rights to another person up to 7 days before the package tour start date. Both the assignor and the assignee are equally responsible for all costs arising from the assignment transaction. The tour participant must notify the cancellation and assignment request in writing.
PROVISIONS REGARDING DISPUTE
In matters not covered in this contract; "Law No. 6502 on Protection of Consumers, Regulation on Package Tour Contracts, IATA, IHA, UFTAA contracts, Civil Aviation Law, Law on Obligations, international agreements to which Turkey is a party and by-laws, regulations, circulars and communiqués linked to them; additionally, the TÜRSAB Kütahya Table, which is the application of the internationally accepted Frankfurter Tabelle in Turkey," provisions will apply.
